Short answer

It depends on the broker. PwC's July 2026 summary says Lebanon's standard VAT rate is 11%[1,2] and VAT applies to commercial transactions by businesses unless exempt. No source we found says whether brokerage commissions carry it in practice. That turns on whether your broker is VAT-registered. Ask before you agree the fee, and get the answer in writing.

What the VAT rule says

PwC's tax summaries, reviewed in July 2026, give Lebanon's standard VAT rate as 11%[1,2]. They also say VAT is levied on all commercial transactions by business entities unless those transactions are specifically exempt. Both pages come from the same publisher, and neither says whether brokerage commissions carry VAT.

That leaves the general rule clear. How it applies to a broker's commission is not published. We found no Ministry of Finance text, court ruling or professional guidance that answers the question directly.

Why it depends on your broker

Whether VAT applies depends on whether the broker is VAT-registered[1,2]. The Ministry of Finance can confirm what an unregistered broker may charge.

The turnover at which registration becomes mandatory is also unsettled. PwC's corporate page says the 2024 Budget Law raised the threshold to LBP 5 billion. Its individual page gives LBP 150 million[1,2]. We have not read the law text, so we treat neither figure as final. A tax adviser or the Ministry of Finance's VAT directorate can tell you the current figure.

Get the fee and the VAT in writing

No law fixes the commission. Under Art. 292 of the Commercial Code the fee is set by agreement; a judge may reduce an excessive fee[3]. Brokers themselves quote a norm of 2.5% of the final price from each side[4,5]: JSK Real Estate wrote this in October 2018, and the president of REAL cited the same rate in a December 2015 interview. Neither source says whether that figure includes VAT. See what commission brokers charge on a sale and who pays the broker.

Under Art. 293 the fee is earned when the broker's work leads to the contract[3], and your agreement with the broker can fix the exact moment. Before the broker starts work, write down the rate, whether any VAT is included or added on top, and when payment falls due. More in when the commission becomes due.

How to settle VAT with your broker

  1. Ask whether the broker is VAT-registered. Do this before you sign anything with them. If they say yes, ask them to show VAT separately on their invoice.
  2. Agree the total in writing. State the rate, whether any VAT is included or added, who pays, and when payment is due. Under Art. 292 the agreement is what sets the fee[3].
  3. Ask for an invoice when you pay. Keep it with your sale papers. If you pay from abroad, have it sent to you before the money leaves your account.
  4. If in doubt, ask the Ministry of Finance. Its VAT directorate can say whether VAT applies to your broker's commission.

It depends on

  • The broker's VAT registration. Whether VAT is added depends on the broker's VAT registration[1,2]. Ask the broker, and confirm with the Ministry of Finance VAT directorate.
  • Whether the broker is a business entity. PwC describes VAT as applying to transactions by business entities[1,2]. How this applies to an individual agent is not published. Ask the Ministry of Finance.
  • The registration threshold. PwC's own pages disagree on the turnover above which registration is mandatory, LBP 5 billion on one and LBP 150 million on the other[1,2]. A tax adviser or the Ministry of Finance can confirm the current figure.
  • What your agreement says. The written agreement sets the fee[3] and should state whether the quoted rate includes any VAT. Whether VAT is due at all depends on tax law. Check the total against the total cost of buying.

Common questions

Does the customary 2.5% broker commission include VAT?

No source says. JSK Real Estate and the president of REAL cite 2.5% from each side as the norm[4,5], and no law fixes the rate[3]. Ask the broker to write down whether VAT is included or added.

Who can tell me whether my broker should charge VAT?

The VAT directorate at the Ministry of Finance. You can also ask the broker directly whether they are VAT-registered, and ask for an invoice when you pay.

Can a judge reduce a broker's fee that seems too high?

Yes. Under Art. 292 of the Commercial Code, a judge may reduce an agreed fee that is out of proportion to the deal and the work required[3]. See challenging a broker's commission.
