Is there a holding-period reduction or exemption from capital gains tax in Lebanon?
On this page
Short answer
Yes. The rule is 8% per full year; exempt from 12 full years[1,2]. For each full year between acquiring and selling, 8% of the gain is deducted, and at 12 full years or more the gain is exempt, provided "the difference is paid in the year of transfer", a condition no source explains. Gains on your primary homes, up to two dwellings, are excluded from this tax.

How the 8% a year deduction works
The tax falls on the gain you made. Before the rate is applied, 8% of that gain is deducted for each full year between the date you acquired the property and the date you dispose of it[1,2]. The text says "full" years, so by its plain wording a part year adds nothing. On that reading, five full years would take 40% off the gain.
Working out the gain itself is a separate step, covered in how the taxable gain is calculated. The holding-period deduction comes off the result.
The 12-year exemption and its open condition
If you held the property for 12 full years or more, the gain is exempt. The law adds a condition: "provided the difference is paid in the year of transfer"[1,2]. No source we read explains what "the difference" is or who pays it, so we do not guess at its meaning here.
Before you rely on the exemption, ask the regional finance office or a tax lawyer two things in writing: what "the difference" means for your sale, and how they count your 12 years. No counting method has been published for inherited property, property bought in parts or off-plan purchases. If you inherited the property, read selling inherited property in Lebanon as well.
How it fits with the 1% rate and the main-home exclusion
The base rate under item (j) is 15%[1], for owners in the groups that item names. Law 330/2024 cuts it, exceptionally, to 1% until 31/12/2026[1,2]. The law text applies the cut to the whole item, but PwC reads it as covering only non-residential property. No source explains how the 8% deduction combines with the 1% rate. See whether you pay 15% or 1%.
Gains on a natural person's primary homes are excluded from this tax, up to two dwellings[1,2]. Kallas Law Firm (May 2026) says this exclusion applies whatever the holding period, and advises documenting your main-residence status (actual residence plus municipal records) before the tax is assessed. No source says what proves a "primary residence" for an owner who lives abroad or only spends summers in Lebanon. More in the main-home exemption.
How to check whether the deduction applies to your sale
- Get an official Land Registry extract (ifadeh aqariyeh). It lists the owners, the source of their right and their shares[3,4]. Copies obtained online or through OMT are unofficial, and according to Legalmondo the official certificate is issued only in person[3,4,5,6]. Ask the Land Registry beforehand which property details your request needs. Kallas Law Firm gives about 2 business days for a physical certificate, though times vary with office opening days[4]. See how to get a Land Registry extract.
- Count your full years. Use the date you acquired the property and the expected transfer date. Ask the finance office which documents and dates it treats as acquisition and transfer, because no source publishes this.
- Get the open points confirmed in writing. Ask a tax lawyer or the Ministry of Finance what "the difference is paid in the year of transfer" means and how the deduction combines with the 1% rate.
- Declare and pay on time. The seller declares the transfer and pays the tax within two months of the transfer[1,2]. In practice the rental-value statement needed for registration is issued only after this tax is paid[2,7]. No source names the form or an online channel, so ask the regional finance office. The steps are in declaring and paying capital gains tax.
