Short answer

No Lebanese law we found sets rules for exclusive or open listings, so put any exclusivity in a signed agreement and have a lawyer read it. The Commercial Code treats brokerage as a contract governed by agency rules[1], with the fee set by agreement; a judge may reduce an excessive fee. An irrevocable sale agency is a power of attorney to sell, not a sale[2].

Forged powers of attorney, including a forged non-revocable one reported by a notary, have been used to try to sell or mortgage property in Lebanon[3,4,5]. This page covers what was published up to 17 October 2026.

Exclusive or open: what Lebanese law says

Lebanon's brokerage rules sit in Articles 291 to 297 of the Commercial Code (Legislative Decree 304/1942). Article 291 defines brokerage as guiding the other party to a deal, or acting as intermediary in the negotiations, for a fee, and applies the rules of agency to it generally[1]. We found no Lebanese source on exclusive versus open mandates, sole-agency clauses or how courts enforce them. Do not assume that exclusive-listing rules you know from Dubai or elsewhere apply here.

Article 293 says a broker earns the fee when the broker's work leads to the contract[1]. It does not deal with competing claims when several brokers worked on the same sale, so settle that in each written agreement. No source we read says what an exclusivity clause adds on top, for example a fee when you find the buyer yourself. See whether you owe a commission if you sell another way.

What to put in writing with the broker

No law fixes a rate or names which party pays, and we found no official tariff for real-estate brokerage[1]. According to JSK Real Estate, a Lebanese agency writing in 2018, and the president of the brokers' syndicate REAL in 2015, custom is 2.5% of the final price from each side. Those are brokers describing custom, not law[7,8]. A judge may reduce an agreed fee that is out of proportion to the deal and the work done. More in whether a court can cut a broker's fee.

The law does not say whether the fee is due at the promise of sale, the notarial deed or registration, so your agreement should fix the moment[1]. If you agree to pay expenses, you owe them even if no sale results. A broker who acts for the buyer in breach of his duties to you loses the fee and his expenses. Read when one broker acts for both sides before you agree to that.

What an irrevocable sale agency is

An irrevocable sale agency (wakala ghayr qabila lil-azl) is a power of attorney that lets someone sell your property. It does not transfer ownership. A buyer holding only such a POA has a personal claim against you, and ownership passes only on inscription at the Land Registry[2]. According to Kallas Law Firm, an ordinary POA older than five years cannot support registration, but settled case law exempts a truly irrevocable mandate from that limit.

The document also counts in the seller's tax clearance. Finance Ministry decision 825 treats an irrevocable POA that includes receipt of the price as a reference date, like a sale contract, when deciding how a Treasury lien affects the rental-value statement[9]. The Lebanese consulate in Dubai lists the irrevocable POA among the types it handles. Revoking a POA there needs a copy of the POA and costs AED 276 per signature, as listed on the consulate's page when we checked in October 2026, so confirm with the consulate before you go[6]. Whether an irrevocable POA can be cancelled against the holder's will is a question for a lawyer. See irrevocable powers of attorney and how to cancel a POA.

Before you hand your property to a broker

  1. Get an official Land Registry extract yourself. It lists the owners, their shares, mortgages, seizures and pending court actions[10,11]. Copies from online services or OMT are unofficial, and any transaction needs the official certificate from the registry office[10,11,12,13].
  2. Write down the mandate. State whether it is exclusive or open, how long it lasts and what happens if you find the buyer yourself. No source gives standard wording, so have a lawyer review it.
  3. Fix the fee and the moment it is due. Put the rate, who pays and whether it is due at the promise, the deed or registration in the same signed document[1].
  4. Ask for copies. The broker must record each deal concluded through him and give a certified copy to any party who asks[1]. Keep your signed agreement and get every offer in writing.
  5. Keep sale powers separate. If you live abroad and someone must sign for you, the POA is signed at a Lebanese mission, or before a local notary and then legalised[14,15,16,17]. Here is how to sell from abroad with a POA.

It depends on

  • The exclusivity clause. No published rule we found covers its effect. A lawyer can tell you what your wording binds you to.
  • What counts as "the contract". The fee is earned when the broker's work leads to the contract, but the law does not say which stage that is[1]. Fix it in writing.
  • Whether the broker also acts for the buyer. JSK Real Estate, a Lebanese agency, wrote in 2018 that one agent for both sides is accepted in Lebanon; that is custom, not law[7]. Under the Commercial Code, a broker who acts for the other party in breach of his duties loses the fee[1].
  • Whether you sign an irrevocable POA with the price received. That document's date counts under decision 825's lien rules[9]. Ask your notary or a lawyer how it applies to your sale.

Common questions

Is an exclusive listing required in Lebanon?

We found no Lebanese law that requires or regulates exclusive listings. The Commercial Code treats brokerage as a contract under general agency rules, so the terms are what you sign[1].

Can I list my apartment with several brokers at once?

No source we found forbids it. Under Article 293 of the Commercial Code, a broker earns the fee when his information or negotiation leads to the contract, but the law does not deal with competing claims between several brokers, so settle that in each written agreement[1].

Does an irrevocable power of attorney make the buyer the owner?

No. A buyer with only an irrevocable POA has a personal claim against the seller, and ownership passes only on inscription at the Land Registry[2].
