Short answer

You can, but according to Kallas Law Firm, any mortgage on the property's folio passes to the buyer unless it is cleared before the sale[1]. Under Law 10/2022, releasing a mortgage that secures an interest-bearing debt needs prior approval of the tax departments[2,3] first. Kallas puts the release fee at 1% of the debt released[3]. Release steps and timing are not published; ask your lender.

Where the mortgage shows, and why buyers care

A Land Registry extract (ifadeh aqariyeh) lists the owners and their shares. It also shows mortgages, pledges, provisional and executive seizures, other charges and pending court actions[6,7]. The buyer's lawyer or notary will read it. According to Kallas Law Firm, every charge on the folio carries over to the buyer unless it is cleared before the purchase[1]. So expect a buyer to want the mortgage gone before or at the sale.

Copies you get online or through OMT are unofficial. A real estate transaction needs the official certificate from the Land Registry[6,7,8,9]. That certificate is issued in person at the Land Registry office that covers the property[10,11]. Kallas gave about 2 business days for a physical certificate in October 2025[7]. More in how to get a Land Registry extract.

Releasing the mortgage: the tax-department approval

Under Art. 40 of Law 10/2022, no one may obtain a full or partial release of a registered mortgage or lien securing an interest-bearing debt without prior approval of the tax departments[2,3]. If the enforcement office enforces the mortgage instead, it withholds the tax from the sums it collects.

Some releases are excluded: passenger cars, agricultural machinery, and residential units owned by natural persons under loans where the interest is taxed in the creditor's own profits[2,3]. We have not confirmed whether an ordinary bank home loan falls under that residential exclusion. Ask your bank in writing whether your loan needs the tax approval and who requests it.

We found no source that describes the practical steps with a bank: the bank's release letter, which tax office gives the approval, or how long each step takes. We also found nothing on how loans from before 2019, taken or repaid in lollars, are settled for a release. Your lending bank and the Land Registry office are the ones who can tell you.

What releasing a mortgage costs

Kallas Law Firm (May 2026) says releasing a mortgage costs 1% of the debt released[3], under item 20 of Table 2 of Legislative Decree 20/1939. Registering a mortgage costs 1% of the secured debt under item 15. We have not checked these figures against the decree text, so ask the notary to confirm the amount before you pay. Kallas also mentions a 0% rate for Housing Corporation loans on one dwelling of a Lebanese citizen.

Guarantees registered for BDH carry no mortgage filing or release fee[4,5]. The purchase registration fee, notary and stamp charges still apply. No source says whether the seller or the buyer pays the release fee, so put it in the sale contract. The seller's other costs are in the total cost of selling.

A bank mortgage is different from a Treasury lien for unpaid taxes. If a Treasury lien was registered before the sale contract, the rental-value statement is not issued, except with the Director of Revenue's approval[12]. Without that statement the sale cannot be registered. See a Treasury lien on your property and the taxes a seller must clear.

How a mortgaged property is sold, as far as the sources go

  1. Get an official, recent Land Registry extract. You or your agent asks for it in person at the Land Registry office that covers the property[10,11]. Ask that office which identifiers to bring with the request, and check that the extract matches the details on your own title deed. Our page on finding your property's number, zone and section shows where to look. Then check every mortgage, seizure and court action the extract lists[6,7].
  2. Ask your bank for the amount to settle and its release procedure. Ask in writing what it needs from you, who obtains the tax departments' approval, and how long the release takes. None of this is published.
  3. Get the tax departments' prior approval. It is required before the release of a mortgage securing an interest-bearing debt, unless your loan is excluded[2,3]. No source names the office, so ask your bank and the regional finance office.
  4. Pay the release fee and have the mortgage struck off the folio. Kallas puts the fee at 1% of the debt released[3]. BDH guarantees carry no mortgage filing or release fee[4,5].
  5. Check a fresh extract, then sign and register the sale. The sale is a notarial deed, and ownership passes only when it is inscribed at the Land Registry[1]. If you want to pay off the loan with the buyer's money at closing, ask the notary and the bank how to arrange it. We found no published procedure.

It depends on

  • Who lent the money. BDH guarantees carry no mortgage filing or release fee[4,5], and Kallas mentions a 0% rate for Housing Corporation loans on one dwelling of a Lebanese citizen[3]. For a commercial bank loan, ask the bank.
  • The type of debt. The tax approval covers mortgages securing interest-bearing debts, with exclusions for some residential loans[2,3]. Your bank can tell you which applies to yours.
  • Whether it is a Treasury lien. A lien for unpaid taxes follows separate Ministry of Finance rules on the rental-value statement[12]. Ask the regional finance office.
  • Selling from abroad. Missions ask for the original deed or a registry certificate for a sale POA, and requirements vary by mission[10,11]. See selling from abroad with a power of attorney.
  • Old loans in lollars. How pre-2019 loans are settled for a release is not documented. Ask the lending bank.

Common questions

Can the buyer simply take over my mortgage?

According to Kallas Law Firm, a mortgage on the folio carries over to the buyer unless it is cleared before the purchase[1]. No source we read describes a bank transferring a loan to a buyer, so ask your bank before you offer it.

How much does it cost to release a mortgage in Lebanon?

According to Kallas Law Firm (May 2026), the fee is 1% of the debt released[3]. Guarantees registered for BDH carry no mortgage filing or release fee[4,5].

Why does the tax department have to approve a mortgage release?

Art. 40 of Law 10/2022 bars the release of a mortgage securing an interest-bearing debt without prior approval of the tax departments[2,3]. Some residential loans, passenger cars and agricultural machinery are excluded.

How long does it take to release a mortgage?

No source publishes a time for the bank, the tax approval or the registry entry. Ask your lending bank and the Land Registry office that covers the property.
