Can a tenant break a lease early in Lebanon, and what notice is needed?
On this page
Short answer
It depends on your lease. We found no published rule on leaving a post-1992 lease before its term ends, or on what you lose, so the lease and your landlord decide. Jaber Law Firm says a tenant leaving at the end of an extended period notifies the landlord two months before the end[1] of that period, by registered mail or through a notary.

What the law says, and what it does not
Leases signed after July 1992 are governed by Law 159/92[1,2,4,6] and the leasing chapter of the Code of Obligations and Contracts, and landlord and tenant set the rent and term freely. Leases signed before 23 July 1992[7,8,9] fall under the old-rent regime, which works very differently: see what happens to old-rent tenants. If you are not sure which side your contract falls on, check whether your lease is old or new.
Two law firms say a new residential lease runs at least three years, on different legal bases. Jaber Law Firm says a tenant on a one-year contract may stay three consecutive years under Art. 543 of the Code of Obligations and Contracts, and Adala Law Firm says a shorter agreed term is treated as three years under Law 159/92[1,2,3]. No law text was read for this page, and Art. 543 may have been repealed, so ask a lawyer which basis applies to your lease.
The two firms also frame the rule differently. Jaber describes it as a tenant's right to stay. Adala says the contract itself is treated as made for three years. Neither says directly whether a tenant who leaves sooner owes rent for the rest of the three years[1,2,3]. Put that question to a lawyer or a notary (kateb adel) before you plan your exit. More in the three-year rule for new leases.
Jaber Law Firm says the three-year rule does not apply to seasonal lets and employer housing[1]. A bill submitted on 25 February 2026 would raise the minimum term from 3 to 5 years (proposed)[3]. As of October 2026 no source reports it adopted.
Leaving at the end of the term
The only notice rule we found covers leaving at the end of a period, not leaving mid-term. Jaber Law Firm says a tenant benefiting from an extension who wants to leave must notify the landlord two months before the end[1] of the extended period, by registered mail or through a notary. A notary letter gives you dated proof that you sent it.
Watch the end date. Adala Law Firm says that if you stay on and the landlord keeps taking rent without objection, the lease is renewed on the same terms and term[2], under Art. 593 of the Code of Obligations and Contracts. That could tie you to a whole new term.
Leaving before the term ends
No source we read sets a notice period, a penalty or a forfeit for a tenant who leaves mid-term. The answer sits in your lease, so look for a termination or early-exit clause and what it says about notice and money. If there is none, the practical route is a written agreement with the landlord on the leaving date, the last rent and the deposit.
You can also try handing the flat to someone else. Jaber Law Firm says that in post-1992 leases subletting for the same use is allowed unless the contract says otherwise[1]. No source says whether subletting releases you from the lease, so you may stay answerable to the landlord. See subletting or handing over a lease.
If you and the landlord cannot agree, Choueh Law Firm says disputes under the rent laws go to the rental court where the property is located[4]. The rulings reported in 2026 were by single judges for rental matters and by rental-disputes chambers of appeals courts.
Your deposit and advance rent
Khatt30 reported in April 2026 that up-front payments are treated differently in practice. The agency commission is not refunded, a deposit (ta'min) may be refunded, and advance months are deducted from rent, with no guarantee that prepaid rent comes back if you leave early[5]. That is practice, not law. Jaber and Choueh law firms say there is no deposit-protection law[1,4] in Lebanon, so refund terms depend on what the lease says. More in deposits and advance rent.
ExpatLife.ai, a commercial expat guide, advises insisting on a written lease that states the rent, the deposit terms and the notice period (August 2026)[10]. Adala Law Firm says oral leases also bind both sides, and a lease can be proved by receipts and witnesses[2]. Without a written lease, your bank transfers and rent receipts are your proof, so keep them.
How to leave a lease with the least loss
- Read your lease. Find the start date, the term, any notice or early-exit clause, and what it says about the deposit and advance rent. If it is in Arabic and you do not read it well, have a notary or lawyer go through it with you.
- Work out your date. If you are leaving at the end of an extended period, Jaber Law Firm says notice is due two months before the end[1] of that period.
- Send formal notice. Use registered mail or a notary, the two routes Jaber Law Firm names[1]. Keep the proof of sending.
- Hand back the flat with a record. Photograph every room and the meters, return the keys against a signed receipt, and keep copies of everything.
- If it turns into a dispute, see a lawyer. Choueh Law Firm says rent disputes go to the rental court where the property is located[4]. A lawyer can tell you whether the three-year rule or your lease's terms work for or against you.
It depends on
- When your lease was signed. Leases signed before 23 July 1992[7,8,9] are old-rent leases with their own rules; this page covers newer ones. See old or new lease.
- What your lease says. No published rule fills the gap on early exit, so a clause on notice, penalties or refunds governs. Ask a lawyer how a court would read yours.
- The kind of let. Jaber Law Firm says the three-year rule does not cover seasonal lets and employer housing[1]. No source defines whether a furnished or short-term flat counts as seasonal.
- Whether the lease has already renewed. If you stayed past the term and the landlord kept taking rent, Adala Law Firm says the lease is renewed on the same terms and term[2].
- How you paid up front. Commission, deposit and advance months are each handled differently in practice[5]. Your receipts show what you paid and for what.
Common questions
How much notice must a tenant give to leave a lease in Lebanon?
For leaving at the end of an extended period, Jaber Law Firm says two months before the end[1] of that period, by registered mail or through a notary. We found no published notice rule for leaving mid-term; your lease decides.
Do I lose my deposit if I leave early?
Will I get my advance rent back if I move out early?
Not necessarily. Khatt30 reported in April 2026 that advance months are deducted from rent with no guarantee they are returned if the tenant leaves early[5].
Can I find someone to take over my flat instead?
Jaber Law Firm says subletting for the same use is allowed in post-1992 leases unless the contract forbids it[1]. No source says this releases you from the lease, so ask the landlord to agree in writing.
