Short answer

It depends on when the lease was signed. In a lease signed after July 1992[1,2,3,4], one law firm says subletting is allowed for the same use unless the lease forbids it[3]. In an old lease, signed before 23 July 1992[5,6,7], the tenant may sublet only with the landlord's written consent or where the contract allows it. The old law also let the spouse, parents and children living there[3,7] take over; whether that survives the 2017 law is not confirmed.

Old leases are changing. For tenants outside the Fund, the nine-year extension ended on 28 February 2026[6,8,9], and as of 13 October 2026 Parliament's Administration and Justice Committee was still studying two old-rent drafts with no decision[10]. This page covers what was published up to 17 October 2026.

First, find out which lease you have

Lebanon has two rent regimes. Residential leases signed before 23 July 1992 fall under the old-rent regime, and leases signed after that date are free contracts[5,6,7]. New leases are governed by Law 159/92 and the leasing chapter of the Code of Obligations and Contracts, under which landlord and tenant set the rent and term freely[1,2,3,4]. The date on your contract decides which subletting and takeover rules apply, so check it first. Here is how to tell if your lease is old or new.

Subletting a lease signed after July 1992

Jaber Law Firm says subletting is allowed for the same use unless the lease forbids it[3]. A clause in the lease that bans subletting prevails. Read your contract before anything else: if it says no subletting, the general rule does not help you.

The use of the flat has to stay the same. Choueh Law Firm says the premises must be used exactly as the lease states, for example as a residence or an office, or the lease may be terminated[2]. Jaber lists using the place for another purpose among the grounds that cancel a post-1992 lease[3]. No source we read says whether letting a flat to tourists by the night counts as a different use from a residence, so if that is your plan, read whether short-term letting is legal and ask a lawyer before you list it.

The sources also do not say who answers to the landlord for a subtenant's unpaid rent or damage in a new lease. Put it in a signed agreement, and ask a lawyer if the sums are large.

Subletting an old lease

Under the pre-1992 regime the tenant may sublet only with the landlord's written consent or where the contract allows it. Even then, the lease stays between the landlord and the original tenant[3], so the subtenant does not become the landlord's tenant.

Jaber Law Firm lists total or partial assignment or subletting without written approval among the grounds for evicting a pre-1992 tenant[3]. Those grounds come from the 1992 law, and how far they still apply alongside the 2014/2017 law was not checked. The end of the extension does not by itself remove a tenant; landlords have gone to court for eviction orders[8,9,11]. More in whether an old-rent tenant can be evicted now.

A family member taking over the lease

Under the pre-1992 regime, if the tenant died or left, the spouse, ascendants and children who lived in the dwelling could take over the lease, provided they had entered it at the start of the lease[3,7]. LCPS also says the right of occupancy could pass to family members. We found no source on whether this right survives under the 2014/2017 law, or after the extension ended in February 2026.

What remains of old leases at all is contested. The Metn appeals court, a lawyer quoted in the press and a landlords' adviser say that once the extension ends without the required steps, the lease falls under ordinary contract law and the tenant must leave or agree new terms[6,8,12,13]. Lawyers quoted by Maharat and a Public Works Studio author argue that Art. 58 suspends the law until the Fund operates; the Metn appeals court held in June 2026 that it does not suspend the tenant's own deadlines[8,11,14]. See what happens to old-rent tenants after February 2026.

For new leases, Jaber Law Firm says a post-1992 lease does not end on the death of the tenant or the landlord[3]. We found nothing on a child or relative taking over a new lease while the tenant is alive, or on who exactly steps into the lease after a death. A lawyer who handles rent cases can tell you, with your contract in hand.

Before you sublet or hand over the flat

  1. Find the signing date on the lease. You do this with the original contract. Before 23 July 1992 means the old regime; after that, a free contract[5,6,7].
  2. Read the lease for a subletting clause and the stated use. In a new lease, a clause banning subletting prevails[3], and the flat must keep the use the lease states[2].
  3. Get the landlord's consent in writing. For an old lease this is required unless the contract already allows subletting[3]. For a new lease it is still good protection. Keep a dated, signed copy, and ask a notary (kateb adel) how to give your request a date you can prove.
  4. Put the sublet terms on paper. Write down the rent, the term, the use and who pays for damage, have tenant and subtenant sign, and keep copies. The Dahye municipalities union says owners must register leases at the municipality where the property lies every year by 31 December, under Interior Minister circular 8/99[15]; check with your own municipality, and ask it whether a sublease can or should be registered, because no source says. See how lease registration works.
  5. For a family takeover, see a rent lawyer before the tenant leaves. Bring the lease and the rent receipts, and ask which documents prove the family member lived there from the start of the lease. If the landlord objects, Choueh Law Firm says disputes go to the rental court where the property is located[2].

It depends on

  • When the lease was signed. Before 23 July 1992 the old rules on written consent and family takeover apply; after it, the Code of Obligations and Contracts applies[1,2,3,4]. Check the contract date, or ask a notary.
  • What your lease says. In a new lease, a no-subletting clause overrides the general rule[3]. A written lease that deals with subletting avoids the argument later.
  • How the flat will be used. Subletting is allowed only for the same use, and no source says how nightly tourist letting is treated. Ask a lawyer and the municipality.
  • Who takes over. The old regime named the spouse, ascendants and children living there since the start of the lease[3,7]. No source we found covers other relatives, or anyone under a new lease; ask a rent lawyer.
  • Where the old extension stands. Courts and lawyers disagree on what remains of old leases after 28 February 2026[8,11,14]. A rent lawyer can tell you how the court in your district has ruled.

Common questions

Can my landlord evict me for subletting without permission?

In an old lease, subletting without written approval is among the eviction grounds listed by Jaber Law Firm[3], and landlords have gone to court for eviction orders[8,9,11]. For a new lease, Jaber's list of cancellation grounds does not mention subletting, so ask a lawyer how a breach of a no-subletting clause is treated.

Does a rental lease in Lebanon end when the tenant dies?

For a lease signed after July 1992, Jaber Law Firm says it does not end on the death of the tenant or the landlord[3]. For an old lease, the 1992 law let the spouse, parents and children who lived there from the start of the lease take over[3,7], but whether that still applies after the 2017 law is not confirmed.

Can I sublet my rented flat on Airbnb?

According to Jaber Law Firm, in a new lease subletting is allowed only for the same use, unless the lease forbids it[3]. No source we read says whether nightly tourist letting counts as residential use, so ask a lawyer and the municipality first.
