Short answer

It depends on the date the lease was signed. A residential lease signed before 23 July 1992[1,2,3] is an old rent, now governed by the 2014 rent law, as amended by Law 2/2017[1,2,4]. A lease signed after that is a free contract under Law 159/92[5,6,7,8] and the Code of Obligations and Contracts, where landlord and tenant set rent and term freely. The date decides how rent, length and eviction work.

Old-rent rules are disputed in court and in Parliament. Earlier appeals rulings favoured tenants, while the 2026 rulings ordered evictions[2,9]. As of 13 October 2026 a parliamentary committee was still studying two old-rent drafts[10]. This page covers what was published up to 17 October 2026.

How to tell which regime your lease is under

The test is the date the residential lease was signed. Most sources put the cut-off at 23 July 1992. LCPS says only "July 1992" without a day[1,2,3], and Choueh Law Firm writes "after the 22nd of July 1992"[5,6,7,8]. If your lease was signed in late July 1992, have a rent lawyer read the contract. At least one news page gives the wrong date of 28 February 1992; the cut-off is in July 1992[14,15].

Watch the law numbers too. Old leases come from Law 160/92 and new ones from Law 159/92, but the law firms' pages swap the two numbers in places[5,6,7,8]. Go by the date and ignore the number a landlord or agent quotes.

A lease signed before the cut-off was not always under the old regime. Jaber Law Firm says Law 160/92 does not cover leases of agricultural land, seasonal summer or winter rentals, employee housing under a work contract, villas built after 25 March 1974, state and municipal property, or furnished places classed as touristic[7].

We found no source on how a renewal, an assignment or a change of tenant after 1992 affects which regime applies. If any of these happened to your lease, ask a rent lawyer one precise question: "Did this create a new contract under Law 159/92, or is it still the original pre-1992 lease?"

Why it matters: old and new leases compared

Old lease (signed before the cut-off)New lease (signed after)
LawThe 2014 rent law as amended by Law 2/2017[1,2,4]Law 159/92 and the Code of Obligations and Contracts[5,6,7,8]
RentLCPS describes rents rising gradually to a fair price; for Fund beneficiaries the law sets the bedel al-mithl (equivalent rent). No source gives the formula, and the assessment committees were never formed[3,11,16]Set by agreement[5,6,7,8]. Adala Law Firm says no increase before the term ends[5]
LengthNine years for tenants outside the Fund, ending 28 February 2026 in the Metn appeals ruling's reading; a lawyer for the landlords' side counts 27 February and Public Works Studio argues 2 March 2026[2,11,12]. Twelve years for Fund beneficiaries, ending 28 February 2029, or 27 February 2029 by the landlords' side count[2,12,16]At least three years, according to two law firms[5,7,13]
Eviction groundsJaber lists two months' unpaid rent after legal notice, misuse, subletting without written approval, owning an equivalent home within seven kilometres, and long absence[7]Jaber lists other use, serious neglect or unpaid rent[7]
SublettingOnly with the landlord's written consent or where the contract allows it, says Jaber[7]Allowed for the same use unless the lease forbids it, says Jaber[7]
If the tenant diesJaber says the spouse, parents and children who lived there from the start can take over[3,7]Jaber says the lease does not end on the tenant's death[7]

The old-lease rows on eviction grounds, succession and subletting come from the 1992 regime. The sources do not say how far these rules still apply alongside the 2014/2017 law, especially after the extension ended. The same is true of the compensation owed when a landlord reclaimed a flat for family use or to rebuild. Jaber Law Firm puts it at 25% to 50% of the property value, Choueh Law Firm at 30% to 50%[3,6,7]. More in compensation for evicted old-rent tenants.

What the cut-off means in October 2026

For old leases, the end of the extension is what matters now. The Fund, an account at the Ministry of Finance under Art. 3 of Law 2/2017, has never operated, and the committees that decide who benefits were never formed[2,4,10,16]. Who counts as a beneficiary, and so who gets twelve years rather than nine, is unsettled[2,12,16]. See who gets 9 years and who gets 12. The end of the extension does not remove a tenant by itself: landlords have gone to court for eviction orders[9,11,12]. On 10 June 2026 the Metn appeals court upheld one such eviction[11,17]. The full picture is in what happens to old-rent tenants after February 2026.

The cut-off may stay central to any new law. At the committee session of 13 October 2026, several MPs asked that the drafts distinguish contracts made before 1992 from later ones[10]. For new leases, a bill submitted on 25 February 2026 would raise the minimum term from 3 to 5 years (proposed)[13]. No source reports it adopted. The current rule is explained in the three-year minimum for new leases.

How to check your lease

  1. Find the original contract. The tenant or the landlord reads the signing date on the first lease, not on later receipts or renewals. Keep a copy, and have it translated if you do not read Arabic.
  2. Check the property type. Confirm the lease is residential and not one of the kinds Jaber Law Firm says Law 160/92 never covered[7]. Shops and offices fall under a separate law, Law 11/2025[18,19].
  3. List every change since 1992. Note any renewal, assignment or new tenant. No published source says whether these change the regime, so take the list to a rent lawyer.
  4. For a new lease, put it on record. The Dahye municipalities union says owners must register leases at the municipality where the property lies every year by 31 December, and that registration is done immediately under Interior Minister circular 8/99[20]. Confirm the deadline with your own municipality. Leases longer than three years should also be inscribed at the Land Registry (السجل العقاري)[7,21]. Here is how to register a lease at the municipality.
  5. Take a dispute to the right court. According to Choueh Law Firm, disputes under both rent laws go to the rental court where the property is located[6]. A rent lawyer is the right next step if the date or the regime is contested.

It depends on

  • The exact day in July 1992. Sources give 22 or 23 July, or just "July"[5,6,7,8]. A lease signed that month needs a lawyer's reading of the contract.
  • The type of property. Seasonal lets, employee housing, villas built after 25 March 1974 and some others were outside Law 160/92, according to Jaber Law Firm[7]. Shop and office leases fall under Law 11/2025[18,19].
  • Fund eligibility. It decides between the nine-year and twelve-year extension, and the committees meant to rule on it were never formed[2,4,10,16]. Ask a rent lawyer.
  • Changes after 1992. No source covers renewals, assignments or new tenants. Ask a rent lawyer whether your lease is still the original contract.
  • Court practice and Parliament. Rulings and drafts were moving as of October 2026[10]. Check with a lawyer before you act.

Common questions

Is a lease signed in 1993 an old rent?

No. Residential leases signed after July 1992 are free contracts, where landlord and tenant set the rent and term freely[5,6,7,8].

Does the 1992 cut-off apply to shops and offices?

Old leases of shops and offices fall under Law 11/2025, in force 12 June 2025[18,19], and one source refers to it as amended by Law 24/2025. Whether and how that law uses a 1992 cut-off is covered in the 2025 non-residential rent law; a rent lawyer can confirm it for your lease.

If an old lease was renewed after 1992, does it become a new lease?

We found no published source that answers this. Ask a rent lawyer to read the original contract and every later document before you rely on either regime.

Can a landlord raise the rent on a new lease mid-term?

According to Adala Law Firm, no: the landlord may not demand an increase before the lease term ends, nor during a tacit renewal[5].
