Short answer

No rule we found fixes the deposit or when the balance is due, so you agree both with the seller in writing. You own the property only once the sale is inscribed at the Land Registry[1]. Before that, check the Land Registry extract, pay as little as you can, and tie the balance to the notarial deed and registration.

In a case the Internal Security Forces reported in June 2026, a buyer bought a property in Halat (Jbeil) whose deed had been forged in the real owner's name, and learned it only when he tried to register it[2]. Have an official Land Registry extract checked before any money moves. This page covers what was published up to 17 October 2026.

Why you pay as late as you safely can

A purchase runs in a fixed order: a recent Land Registry extract, an optional promise of sale, the notarial deed, then inscription at the Land Registry. Ownership passes only on inscription[1]. Kallas Law Firm explains that ownership is transferred by the notarial deed inscribed at the registry; a power of attorney or a private agreement does not transfer it. Money you pay before inscription gives you a claim against the seller, not the property[1,3].

Until inscription, the property stays in the seller's name and exposed to any sale, mortgage or seizure entered before yours[1]. Between two buyers of the same property, the one entered first in the registry's daily journal ranks first, whatever the dates on the deeds[5]. Kallas Law Firm says selling the same property twice counts as fraud under the Penal Code[12]. A criminal conviction does not by itself give your money back.

What to settle before you pay a deposit

No source we read sets a usual deposit size, a usual schedule for the balance, or what happens to a deposit when a deal falls through. You negotiate those terms and write them into the promise of sale. Have a Lebanese property lawyer draft them, because those clauses decide whether you can get your money back.

A promise of sale can be provisionally inscribed on the property's folio. That keeps your rank against any later sale or mortgage, and without it the promise cannot be relied on against third parties acting in good faith[1,4]. It does not by itself make a deposit refundable. Provisional inscriptions also lapse after one month, six months, two months or up to one year[5], depending on how they were made. We found no published fee for inscribing a promise, so ask the notary (kateb adel) for a written quote and how long the inscription would last.

Moving the money

The sources describe a cash market. JSK Real Estate, an agency, says purchases in 2025 were paid in full in cash or by bank transfer of the whole amount, mostly in USD[13,14]. Assukna, a property venture, wrote in April 2026 that most deals are funded through exchange houses, trusted couriers or occasionally international wires, and not through Lebanese bank accounts. It advises planning and documenting the method with a lawyer[15]. Both are interested parties, and neither says which route is safest.

Agree with the seller where the money lands before you sign anything. JSK wrote in 2023 that some sellers want payment to an account outside Lebanon while buyers hold cash in Lebanon, or the reverse[16]. No source we read explains how to make a transfer from abroad arrive at the moment the deed is signed. Ask your lawyer how the balance will be held and released, and write that into the promise of sale. More options are in sending money to Lebanon for a property.

Cash worth more than USD 15,000 that you bring into Lebanon must be declared in writing to customs[10]. For cash carried out, the law allows disclosure to customs on request instead, under implementing procedures we could not find, so check with Lebanese Customs before you travel in either direction. Customs can hold undeclared cash and refer it to the Public Prosecutor at the Court of Cassation. Notaries, lawyers and brokers have anti-money-laundering duties on property sales, but the law does not list which documents a buyer must show, so ask the notary in advance what proof of funds they will want.

The fees you also have to fund

On top of the price, the Land Registry fee on a sale is 3% of the value for Lebanese buyers, 5% for non-Lebanese[11]. For built property it is charged on the higher of the estimated value set by the Ministry of Finance and the declared price[17,18]. We found no confirmed rule for the base on unbuilt land, so ask the notary or the regional finance office[19,20]. State fees are collected in Lebanese pounds[19,21].

Stamp duty on the sale contract is 0.4%[20,22]; confirm it with the notary. Sources disagree on the exchange rate used to convert a dollar price for stamp duty: Kallas Law Firm cites the previous day's rate, PwC the Sayrafa rate. Under Law 64/2017 and a Ministry of Finance circular, a 2% advance on the transfer fee is paid within 15 days of a surveyed sale contract, and it is not refunded if the sale is not registered within one year. Whether it is still collected this way since Law 10/2022 is not confirmed[22,23]. Ask the notary for a written list of every fee, who pays it and in which currency, so your agent has the money ready on the day.

How to pay the deposit and the balance from abroad

  1. Get an official Land Registry extract (ifadeh aqariyeh) for the exact property. Your lawyer, or someone you trust in Lebanon, requests it at the land registry office for the area where the property lies[24,25]. They need the property's governorate, district, real estate zone, property number, section and block[25,26] (the last two where they apply). For a flat, the unit has its own number added to the plot number, with its own folio[27]. According to one law firm, certificates are public and anyone may request one without showing a legal interest, but none is issued while a lien or a registration on the plot is still in process[25]. That same firm put the fee at USD 5 in June 2025, and Kallas Law Firm gives about 2 business days for a physical certificate[28]. Copies from OMT or online are unofficial and for reference only[25,26,28,29]. More in how to check a title deed.
  2. Read the extract before any money moves. It lists the owners and their shares, mortgages, seizures and pending court actions[25,28]. Every charge on it passes to you unless it is cleared before the purchase[1]. The person you will pay must be the registered owner, or must act for that owner.
  3. See the property on the ground. For land, where the cadastral plan and the boundaries on the ground differ, the plan prevails[5,30]. Have a surveyor or engineer you hire yourself show you the plot against the plan. We found no published fee for this. See getting a cadastral map or survey.
  4. Check the seller's power of attorney, if there is one. Kallas Law Firm says an agent who registers a sale must produce a power of attorney no more than 5 years old[31,32], and that an ordinary POA can be revoked at any time. Forged POAs and IDs have been used to try to sell property and to mortgage it[33,34,35]. See checking that a power of attorney is genuine, and ask the notary to confirm the POA before you pay.
  5. Name your own agent. Sign a POA in person at a Lebanese embassy or consulate, or before a local notary, then have it authenticated locally and legalised by the Lebanese mission[6,7,8,9]. Missions ask for the property number and location, plus a copy of the deed or a Land Registry extract[6,8,36], so bring the extract from step 1. Details are in giving a power of attorney from abroad.
  6. Put the deposit in a signed promise of sale. Write in the amount, the currency, where and how it is paid, the date set for the notarial deed, and what happens to the deposit if either side pulls out. Ask the notary whether the promise can be provisionally inscribed on the folio[1,4].
  7. Pay the deposit by a route that leaves a record, and get a receipt. A transfer to an account in the registered owner's name leaves a trail. For cash, get a signed receipt that names the property number and the amount; see proof when you pay a seller in cash. If a broker is involved, the broker must record the transaction and give a certified copy to any party who asks[37].
  8. Pay the balance at the notarial deed and file it at once. Your agent signs the sale before a notary, or before the competent assistant head of the Land Registry office[23,31]. Release the balance only at that signing. Have the deed filed at the registry as soon as you can, because rank goes by entry in the daily journal[5].
  9. Get a fresh extract in your name. You own the property once the sale is inscribed[1]. Ask your agent for a new extract showing you as owner, and keep copies of every receipt and contract.

It depends on

  • Where the seller wants the money. JSK Real Estate, a broker, wrote in 2023 that deals close more easily when the seller accepts payment either abroad or in Lebanon[16]. Settle where the money goes before the promise of sale, and ask your lawyer how to document it.
  • Who signs for the seller. If an agent sells under a POA, you carry the risk that it was revoked or forged. Have the notary check it before you pay anything.
  • Your nationality. The Land Registry fee is 3% of the value for Lebanese buyers, 5% for non-Lebanese[11], and foreigners can own up to 3,000 m²[3,38,39] in total without a licence. We found no official text on dual nationals, so ask the notary how you will be treated.
  • How the money travels. Cash worth more than USD 15,000 brought into Lebanon must be declared in writing to customs[10], and transfer apps have caps (Taptap Send via Whish: USD 5,000 per transfer and per month[40] as of October 2026). Ask your bank abroad and Lebanese Customs before you move large sums.
  • Where the property is. In September 2026 the Cabinet approved a draft law that would bar sales of property in Israeli-occupied towns of the south until the occupation ends, and it still needs Parliament's approval[41,42]. As LBCI reported the draft, promises and notarised contracts there made since 8 October 2023 could not be completed without a committee's approval[41]. Take legal advice before paying a deposit on property in the south.

Common questions

Can I pay the full price before the deed is signed?

You can, but until the sale is inscribed at the Land Registry you hold only a personal claim against the seller, not the property[1,3]. In that time the property can still be sold, mortgaged or seized in the seller's name[1].

Do I get my deposit back if the sale falls through?

We found no rule on this. It depends on what the signed promise of sale says, so write the refund terms in before you pay and have a lawyer read them.

Can I send the deposit through Whish or OMT?

It suits small sums: as of October 2026, Taptap Send's limit for transfers paid out through Whish is USD 5,000 per transfer and per month[40], and its MTM cash pickup allows USD 9,900 per transfer. Taptap Send says a Whish recipient who needs to receive more may have to fill in a Whish form and justify the transfer. We found no published OMT limit for incoming transfers.

Do I have to travel to Lebanon to complete the purchase?

No. A person you name in a power of attorney can sign the sale and register it for you[23,31]. The POA is signed at a Lebanese embassy or consulate, or before a local notary and then legalised[6,7,8,9].
