Is the price in the deed the real price I paid, and what are the risks of declaring less?
On this page
Short answer
Not necessarily. The deed shows the price you and the seller declare. The registration fee on built property is charged on the higher of the estimated value and the declared price[1,2], and the registry officer may set a higher value. We found no published penalty for declaring less, but in a pre-emption case you cannot claim you paid more than the registered price[3]. Ask the notary and a lawyer.

The seller's gains tax is 1% until 31/12/2026[4,5], then 15%[4] unless a later law extends the cut, and it is not settled whether the contract date or the registration date counts, so for a sale close to 31 December 2026 check with the Ministry of Finance or a tax lawyer. This page covers what was published up to 17 October 2026.
Key facts
What the price in the deed is used for
A sale is signed as a notarial deed and becomes yours only when it is inscribed at the Land Registry[11]. The price written in it is the price you and the seller declare, and several charges are worked out from it. Stamp duty is 0.4%[5,8] of the contract value. According to Kallas Law Firm, flat stamps of LBP 200,000 on the contract and LBP 100,000 on the deed are added to that[5].
The registration fee (3% of the value for Lebanese buyers, 5% for non-Lebanese[7]) follows the declared price only when that price is above the official estimate[5,6]. Under a 2017 rule, a 2% advance on the contract price, plus the municipal fee, is paid within 15 days of a surveyed sale contract. Whether this advance is still collected the same way since Law 10/2022 is not confirmed[8,9].
The deed price has not always matched the cash. Libnanews (August 2026) reports that between 2019 and 2022 many sales were paid with bank cheques drawn on blocked dollar deposits, so recorded prices from those years could be several times their cash value[12].
Why declaring less often does not cut the registration fee
For built property, Art. 76 of Law 10/2022 sets the base of the transfer fee at the rental value × 30, if higher than the declared price[5,6]. The regional finance office makes the estimate; in Beirut this is the built-property tax department. The Land Registry must apply that estimate unchanged when it is higher than the declared price. The registry officer may also set a higher value at his discretion, and LeBusiness notes that declaring a low price to save fees will not always work[1,2].
In a 2015 interview, the president of the brokers' syndicate REAL said the registry can point to what another buyer in the same building paid per m². That is one broker's account from 2015, and the registry has not confirmed it as practice[13]. The estimate is often far below the market price[5]. Where the declared price is higher, the fee follows the price[1,2].
The estimate reaches your sale through the rental value statement. Where there is no Treasury seizure on the property, the finance office issues it once the seller has paid the built-property tax and the capital gains tax on the property[5,6]. Different rules apply if the extract shows a Treasury seizure; we have not read them, so ask the regional finance office or a lawyer. See what the rental value statement is, and estimated value versus declared price for how the two numbers compare.
The ×30 rule is written for built property, and the sources we read do not confirm the fee base for unbuilt land[5,6]. A land sale uses a municipal statement of contents instead of the rental value[14,15]. Ask the notary how the fees on your plot will be calculated before you agree a price.
Paying in fresh dollars: which number, which rate
Taxes and fees are collected in Lebanese pounds[6,10], and where a foreign amount must be converted, the Banque du Liban rate applies. The sources we read do not say which rate the Land Registry uses when the declared dollar price is above the lira estimate.
For stamp duty, the rate is disputed. Kallas Law Firm (May 2026) cites Art. 17 of the stamp-duty law, which uses the previous day's rate. PwC (July 2026) cites Ministry of Finance decision 684 of 23 November 2023, which requires the Sayrafa rate[5,8]. Ask the notary which rate applies on the day you sign.
BLOMINVEST's registry reports quote USD/LBP 89,500 (from 1 February 2024)[16]. The bank uses it to convert figures for its reports and does not say it is the rate used to collect fees. The LBP 1,500 per USD rate under Law 40/2026 applies only to contracts entered in the daily register before 1 January 2020 and paid by 31 December 2026. New purchases do not qualify[5,17]. More in which exchange rate the fees use.
The risks of declaring less
We found no published rule setting a penalty for declaring a price below what was paid, and no court case on it. That gap in our sources gives you no protection. This page does not advise declaring less, and a property lawyer is the right person to ask about your own deal.
One risk is written into the Code of Real Property. When a co-owner's share is sold to an outsider, another co-owner can take the buyer's place on identical terms after the sale is registered[3] . The pre-emptor must consign the sale price, and the buyer cannot claim that the real price was higher than the price in the registered contract. See buying or selling a share and pre-emption.
The seller pays gains tax on the gain[4]. The text of Law 330/2024 applies the temporary 1% to the whole item; PwC reads it as covering only non-residential property[4,5]. Ask the Ministry of Finance or a tax lawyer which applies to your sale. The sources we read do not say how the finance office sets your purchase cost when you later sell, so ask a tax adviser how the price in your deed will be treated. More in the 15% or 1% gains tax.
Under Law 44/2015, notaries, lawyers and brokers have anti-money-laundering duties when they handle property sales. The law does not list which documents a buyer must show, and practice varies by notary and bank[18]. Keep a record of every payment you make: see getting proof when you pay a seller in cash.
How to check the price and the fees before you sign
- Get a recent Land Registry extract. It is requested at the land registry office for the property's area[15,19]. Give the property's governorate, district, real estate zone and property number, plus the section and block where they apply[19,20]. An OMT agent can also give you a copy of the title register; OMT asks for the same details plus a mobile number and email address. Our sources do not publish the fee or the processing time, so ask the registry office or OMT. The extract lists the owners, their shares, mortgages, seizures and pending court actions[19,21].
- Pay in a way you can prove. Use bank transfers where you can, get a signed receipt for any cash, and keep copies of everything.
It depends on
- Your nationality. According to Kallas Law Firm (May 2026), only the buyer's nationality decides between the 3% and 5% rates[5]. No source covers dual nationals, so ask the notary.
- Buying a share, not a whole property. If you buy a co-owner's share as an outsider, the other co-owners can pre-empt at the registered price[3] .
- The seller's tax position. Gains on a person's primary residences are excluded, up to two dwellings[4,5]. The law deducts 8% of the gain for each full year held and exempts the gain after 12 full years, provided the difference is paid in the year of transfer. No source explains that proviso, so ask a tax adviser what applies to the seller.
Common questions
Does a lower price in the deed lower the registration fee on an apartment?
What exchange rate converts a fresh-dollar price for the fees?
Is there a penalty for declaring less than I paid?
Can a co-owner take a share I bought at the price written in the deed?
Yes, if you bought a co-owner's share as an outsider. Another co-owner can step into your place on identical terms after registration[3]. You cannot then claim that the real price was higher than the registered one.
